No, you can't sue, but you can hire a lawyer to appeal. There are many out there that will take the case on contingency, meaning if you win, they will take a percentage of the back pay and if you loose, you don't pay. About all claims are denied the first time, even if the person is terminally ill. It has been almost 2 years since my husband applied, was denied, appealed, went before the administrative law judge back at the end of last year (2010) and now waiting for a decision.
