Can you please help me with this tax ?

my spouse and i are only common law married , but for the past 2 years he has been recieving a check through a private insurance and last year he was able to claim his tax return because the company that was paying him after injury was taking taxes out , but then the company sold there company and now a private insurance picked it up and started paying him (ITS NOT WORKERS COMP OR A DISABILTY CHECK) but he tried to file his tax return this year and he was told that he couldnt because it was non taxable, because the private insurance is not taking anything out. is there anything else we can do
